TERMS AND CONDITIONS
Booking and Payment
Deposit: A non-refundable deposit of $100 is required to confirm your session. This deposit will be credited towards your final package. While the deposit is non-refundable, it may be transferable.
Package Selection: The Client agrees to pay the remaining balance of their package on the session date. Any upgrades or additional products must be finalised within 7 days of receiving their online gallery.
Payment: Full payment for packages and products must be received before processing your order. Payments can be made via bank deposit or PayPal.
Cancellation and Rescheduling
Cancellation: If the Client needs to cancel the session, the deposit will not be refunded. Rescheduling is allowed with at least 48 hours' notice, subject to availability. A new deposit may be required for rescheduled sessions.
Weather and Environmental Conditions
Rescheduling Due to Weather: If the session is affected by inclement weather or other environmental factors, the session will be rescheduled at no additional cost, subject to availability.
Cooperation
Child Supervision: An adult must be present at the photoshoot to supervise and ensure the safety of the child(ren) at all times. The Photographer is not responsible for supervising the Client's child(ren).
Session Cooperation: The Client agrees to cooperate and communicate positively leading up to and during the photo session. The Photographer cannot guarantee specific images and is not liable if key individuals fail to appear or cooperate.
Photography Restrictions: To avoid disruption and ensure the Photographer can fulfil their contracted duties, family or friends' photography during the session is not permitted.
Health and Safety
Protocols: The Photographer follows strict hygiene practices to ensure the safety and well-being of all participants. The Client is responsible for informing the Photographer of any health concerns or conditions that may affect the session.
Timelines
Image Delivery: High-resolution JPEG images (4500 pixels on the longest side, 15 x 10 inches at 300ppi) will be posted to the Client’s online gallery within four weeks of the session date.
Selection and Payment: The Client must choose their final package and finalise payment within 7 days of receiving their gallery.
Digital Files: The Client will download a zip file of digital images from the online gallery. A physical disc or USB will not be provided.
Image Management: The Client acknowledges responsibility for downloading, unzipping, and backing up their images. The Photographer is not responsible for user errors in this process.
File Storage: Digital files remain the property of the studio and will be kept on file for three years.
Artistic Style & Culling
Image Selection: After the session, images undergo a selection process where the Photographer chooses those meeting high standards of quality. Unflattering poses and duplicates are removed.
RAW Images: RAW images will not be released to the Client. The Photographer selects the best images for the Client’s gallery, and no additional images will be available.
Copyright and Privacy
Copyright: The Photographer retains copyright of all images and may use them for promotional and advertising purposes. If you wish to keep the photos private, please notify the Photographer in writing.
Usage: Purchased products (including digital files) are for personal use only. Commercial use or entry into competitions is not permitted. Images must not be scanned or altered. Copying, screen captures, or downloading images from the Photographer’s website, blog, or social media pages is prohibited.
Handling
Image Loss: The Photographer is not responsible for the loss of digital images once delivered. It is the Client’s responsibility to back up their images.
Print Quality: The Photographer is not responsible for printing errors or the quality of prints or products not ordered directly through her. For best results, prints larger than 10x15 inches should be ordered through the Photographer.
Liability
Liability: The Photographer is not liable for any accidents or damages that occur during the session. The Client is responsible for any damage caused to the Photographer’s equipment or property.
Dispute Resolution
Resolution: Any disputes arising from the services provided will be handled amicably. If a resolution cannot be reached, the dispute will be referred to mediation before pursuing legal action.
